Terms of Service

These general terms govern your use of this website and Proskuneo Digital's professional services unless a signed agreement states otherwise.

Last updated: October 30, 2026

1. Acceptance of terms

By using this website or purchasing services from Proskuneo Digital, you agree to these terms. If a proposal, statement of work, order, or other signed agreement conflicts with these terms, the signed agreement controls for that engagement.

2. Services and project scope

Services may include website design, development, hosting, maintenance, branding, marketing, consulting, communications, and related digital work. Project scope, deliverables, schedule, fees, revisions, and responsibilities will be described in the applicable proposal or agreement. Requests outside the agreed scope may require additional fees and time.

3. Client responsibilities

Clients must provide timely content, access, approvals, accurate information, and lawful materials needed to perform the work. Delays in these items may affect schedules. Clients represent that they have the rights and permissions necessary for all materials they provide.

4. Fees, invoices, and taxes

Fees and payment schedules are stated in the applicable agreement. Unless otherwise stated, invoices are due upon receipt. Late or unpaid balances may result in paused services. Clients are responsible for applicable taxes, third-party fees, licenses, domain registrations, advertising spend, and similar expenses unless expressly included.

5. Revisions, cancellation, and refunds

Included revisions are limited to those stated in the project scope. Either party may end an engagement according to the applicable agreement. The client remains responsible for completed work, committed expenses, and noncancelable third-party costs. Deposits and payments for completed work are generally nonrefundable unless required by law or otherwise agreed in writing.

6. Intellectual property

Each party retains ownership of materials it owned before the engagement. After full payment, the client receives the rights to final deliverables described in the agreement, excluding Proskuneo Digital's preexisting tools, templates, methods, code libraries, and third-party materials. We may display completed public work in our portfolio unless confidentiality terms prohibit it.

7. Third-party services

Domains, hosting platforms, plugins, payment processors, social networks, analytics, and other third-party services are governed by their own terms and availability. Proskuneo Digital is not responsible for third-party outages, changes, suspensions, security incidents, or pricing changes beyond our reasonable control.

8. Acceptable use

You may not use our website or services for unlawful, fraudulent, abusive, infringing, malicious, or security-disruptive activity. We may suspend affected services when reasonably necessary to protect systems, users, or legal compliance.

9. Confidentiality

Each party will use reasonable care to protect confidential information received from the other and will use it only for the engagement, except where disclosure is authorized or legally required.

10. Disclaimers and limitation of liability

Except as expressly stated in a signed agreement, services are provided on an “as available” basis without guarantees of uninterrupted operation, specific search rankings, revenue, audience growth, or business results. To the maximum extent permitted by law, Proskuneo Digital will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability related to a claim will not exceed the fees paid for the specific services giving rise to that claim during the preceding six months.

11. Indemnification

You agree to defend and indemnify Proskuneo Digital against claims arising from materials you provide, your unlawful use of deliverables or services, or your violation of these terms or third-party rights.

12. Governing law

These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. The parties will first attempt in good faith to resolve disputes informally before pursuing other remedies.

13. Changes and contact

We may revise these terms prospectively by posting an updated version. Questions may be sent to info@proskuneoweb.com.
